The European AI Regulation (AI Act) will enter into force in phases over the next few years and will have a direct impact on educational institutions. This legislation introduces a risk-based approach to artificial intelligence, classifying AI applications based on their impact on individuals and society.
In education, this can include AI systems that monitor and predict student learning performance as well as AI systems that support teachers in reviewing and grading tests. The AI Act designates systems that influence assessment, selection or decision-making as "high risk" and are subject to strict transparency, documentation, oversight and accountability requirements. High time for the director of the educational institution to get timely and proper information.
What is the AI Act?
The AI Act is a law that regulates artificial intelligence systems based on risk, with the goal of protecting fundamental rights, security and public values. The AI Act went into effect on Aug. 1, 2024, and will apply in phases between 2025 and 2027, with obligations for high-risk AI systems no later than 2027.
Shared responsibility
The AI Act places primary obligations on suppliers of AI systems, such as conducting risk assessments, providing transparent documentation and demonstrating that high-risk AI systems meet legal requirements. However, educational institutions themselves remain responsible for careful, explainable and auditable deployment of AI. This means, among other things, that decisions made (in part) by AI must be explainable, that human intervention is safeguarded, and that risks such as discrimination and bias are identified.
Understanding AI applications
For administrators, this means that timely action is necessary. A good starting point is the comprehensive mapping of all AI applications within the educational institution, followed by a risk analysis in accordance with the AI Act. On this basis, policy, frameworks and decision-making processes can be set up that meet the legal requirements and are in line with the (public) values of education.
